Key Questions About Minnesota DWI Laws

What is the difference between DWI and DUI in Minnesota?
In Minnesota, the legal offense is DWI (Driving While Impaired). The term “DUI” is commonly used in conversation but does not appear in Minnesota statutes. A DWI charge can involve alcohol, drugs, or intoxicating substances, including driving with a blood alcohol concentration (BAC) of 0.08 or higher.
A Minnesota DWI conviction generally remains on your criminal record unless it is expunged by court order. Expungement eligibility depends on the offense level and statutory waiting periods. Some cases may qualify for petition-based expungement if legal requirements are met under Minnesota law.

Under Minnesota’s Implied Consent law, drivers are required to submit to a chemical with substance when lawfully requested after a DWI arrest. Refusing a breath test is itself a criminal offense and may also lead to driver’s license revocation and additional penalties.

After a DWI-related license revocation in Minnesota, drivers may request administrative review and can petition the court for judicial review within 60 days after receiving the notice of revocation. Missing this deadline can make it harder to challenge the loss of driving privileges.
